Federal Administrative Court confirms practice of the FDPIC
In its ruling of 22 June 2026, the Federal Administrative Court dismissed Inkasso-Team AG’s appeal, confirming that the publication of personal data for the purpose of locating alleged debtors and warning third parties is a violation of personality rights and cannot be justified.
Inkasso-Team AG published personal data of alleged debtors on a website to solicit public assistance in determining their whereabouts while also warning third parties about these individuals.
In its investigation opened in September 2024, the Federal Data Protection and Information Commissioner (FDPIC) concluded that, by publishing this personal data – some of which is particularly sensitive – the company had violated data protection principles, with no legal justification.
On 28 April 2025, the FDPIC ordered the company to cease publication within 30 days and delete the data already published.
Inkasso-Team AG appealed this ruling to the Federal Administrative Court, which fully dismissed the appeal in its decision of 22 June 2026.
The Federal Administrative Court’s judgment has since entered into legal force, and the website has been taken offline.
