FDPIC warns website operator for publishing personal data
The Federal Data Protection and Information Commissioner (FDPIC) has issued a warning to the operator of a website. On the platform, documents, photos and copies of identification cards of alleged debtors were publicly accessible.
In January 2026 the FDPIC became aware of the unlawful publication following a report. Consequently, in February 2026 he launched an investigation under Art. 49 of the Federal Data Protection Act (FADP). The investigation examined whether the disclosure of the data was proportionate.
During the investigation the FDPIC clarified the facts and granted the website operator a right to be heard. At the same time he informed the operator of the possibility to take measures during the proceedings to comply with data protection regulations. The data controller subsequently deleted the published data.
According to Art. 51 paragraph 5 FADP, the FDPIC may close a procedure without issuing a formal ruling, provided that the data controller implements the required adjustments. The FDPIC therefore issued a warning and charged the outstanding procedural fees.
