Findings and rulings

If, in the course of an investigation pursuant to Art. 49 FADP, the FDPIC finds that data protection provisions have been violated, he has the power to order administrative measures pursuant to Art. 51 FADP. The latter are usually issued in the form of a ruling within the meaning of Art. 5 of the Federal Act on Administrative Procedure (APA).

Under Art. 57 para. 2 FADP, the Commissioner shall inform the public of his findings and rulings in cases of general interest. The controller may challenge the measure itself and the publication of the ruling announced in advance by the FDPIC separately before the Federal Administrative Court. This section therefore contains all rulings of general interest whose publication has either remained uncontested or has been confirmed by a final court ruling.
